 Medical FundingYou have a patient that was severely injured when a drunk driver spun out of control and slammed into his vehicle. The vehicle was totaled, and your patient was transported to a hospital emergency room. Your patient receives treatment as a result of the Emergency Medical Treatment and Active Labor Act of 1986 (EMTALA). This is a federal statute that, although it only applies to participating hospitals that accept payment from the Department of Health and Human Services Centers for Medicare and Medicaid Services (CMS) under the Medicare program, in practical terms applies to all hospitals, with the exception of military hospitals, and applies to all patients, not just Medicare patients, until they are medically stable.

 Medical Care FundingAfter your patient is released from the hospital, he is advised to seek any further treatment from his doctor. Your patient does not have health insurance or any financial resources to pay for these services, and turns to his legal representative to assist in funding medical care providers that will accept lien-based funding. It has been Infinity’s experience that many attorneys do have relationships with some common specialty providers who have agreed to provide lien-based medical care. So your patient is seen by a spine surgeon who recommends a two-level fusion to be performed at a nearby hospital. The surgery is defined as an elective surgery, and is therefore not life-threatening, thereby falling outside of the EMTALA. There are a few choices: a) have the patient seek funding; b) find a hospital that may be comfortable performing lien-based medical care; c) turn to Infinity, who either already has contracts with many hospitals, or if a provider wants to use a hospital where Infinity does not have an existing relationship, we will enter discussions to negotiate a contract.

Healthcare FundingYour patient, who has no health insurance, is severely injured and receives emergency room care, which included a surgery as in the first scenario. He is released and advised to seek follow up treatment from a provider. You have specialized in personal injury for many years, and you are able to find a general orthopedic surgeon for your patient. Your patient develops osteomyelitis (infection of the bone), and the surgeon needs to refer him to an infectious disease specialist for treatment. Infinity is aware that these specialists are rarely willing to treat on a lien basis. This is when Infinity can step in to assist in your patient’s treatment.
